Section 16: Wages for two or more classes of work

"Where an employee does two or more classes of work to each of which a different minimum rate of wages is applicable, the employer shall pay to such employee in respect of the time respectively occupied in each class of work, wages at not less than the minimum rate in force in respect of each such class."


Different Types of Work: If an employee performs two or more distinct types or categories of duties (e.g., Social Media Designing vs. CorelDraw Printing Work), the employer cannot lump them together into a single basic payment if they fall under different skill levels or wage categories


Time-Based Payment: The employer is legally obligated to pay the worker according to the specific time spent on each class of work at the respective rate.


How It Applies to Your Freelance/Design Case:

  • Original Scope: Your initial agreement/advertisement was for Canva & Photoshop (Social Media Designing).

  • Additional Scope: You were assigned CorelDraw printing work (banners, standees, visiting cards), which is a separate, technical class of work.

  • Legal Outcome: Under Section 16, the employer must compensate you separately for the additional CorelDraw work based on the applicable market or skill rates for that specific task.

Section 20: Claims

(1) The appropriate Government may, by notification in the Official Gazette, appoint any Commissioner for Workmen's Compensation or any officer of the Central Government... or any officer of the State Government not below the rank of Labour Commissioner... to be the Authority to hear and decide for any specified area all claims arising out of payment of less than the minimum rates of wages...

(3) When any application under sub-section (2) is entertained, the Authority shall hear the applicant and the employer... and, after such further inquiry, if any, as may be necessary, may, without prejudice to any other penalty to which such employer may be liable under this Act, direct—

  • (i) in the case of a claim arising out of payment of less than the minimum rates of wages, the payment to the employee of the amount by which the wages payable to him exceed the amount actually paid by him, together with the payment of such compensation as the Authority may think fit, not exceeding ten times the amount of such excess;

  • (ii) in any other case, the payment of the amount due to the employee, together with the payment of such compensation as the Authority may think fit, not exceeding ten rupees;

Simplified Explanation 

  • Filing Claims for Unpaid Dues: Section 20 provides the legal mechanism for an employee to file a formal claim before the designated Labour Authority/Commissioner if they are unpaid, underpaid, or denied proper remuneration for their work.

  • Recovery of Pending Wages: Under this section, the Labour Authority can direct the employer to pay the exact remaining balance owed to you (such as your pending fees for the additional CorelDraw printing work).

  • Claiming Compensation (Up to 10 Times): In cases where wages were withheld or paid below the prescribed/agreed minimum rates, the Authority has the power to award compensation up to ten (10) times the unpaid amount as a financial penalty against the employer for delaying or withholding payment.

  • Time Limit: An application under Section 20 must generally be filed within six months from the date the wages became due (though delay can be condoned by the Authority if sufficient cause is shown).

Instead, Intel processors are now divided into two main categories:

Intel Core Processors: Standard mainstream chips (e.g., Intel Core 5, Intel Core 7).
Intel Core Ultra Processors: Premium, high-performance chips featuring advanced AI capabilities (e.g., Intel Core Ultra 5, Intel Core Ultra 7, Intel Core Ultra 9).

Additionally, instead of "15th Gen," Intel introduced Series branding (e.g., Intel Core Ultra Series 1 and Series 2).

 

When Did This Change Happen?

June 2023 (The Announcement): Intel officially announced that it was dropping the "i" and changing its naming strategy ahead of its upcoming chip lineup.
December 2023 (The Rollout): The new brand hit the market with the release of code-named "Meteor Lake" laptop chips, officially sold as Intel Core Ultra Series 1.
Late 2024 (The Desktop Shift): What enthusiasts expected to be "15th Gen Desktop CPUs" launched under the code-name "Arrow Lake" as the Intel Core Ultra 200S series.

 

Why Did Intel Change the Branding?

Intel didn't just change the name for fun this was driven by one of the biggest technology transitions in computing history.

परिचय

आज के समय में हजारों Graphic Designers, UI/UX Designers, Packaging Designers, Motion Graphic Designers और Creative Professionals निजी कंपनियों में कार्यरत हैं। लेकिन कई बार कंपनियाँ बिना उचित कारण नौकरी से निकाल देती हैं या केवल "Performance Poor" बताकर Termination Letter जारी कर देती हैं।

ऐसी स्थिति में सबसे बड़ा सवाल यह होता है—

क्या Professional Graphic Designer Labour Court जा सकता है?

या Civil Court में केस करना होगा?

इस लेख में हम भारतीय श्रम कानून के अनुसार पूरी जानकारी सरल हिन्दी में समझेंगे।


क्या हर Graphic Designer Labour Court जा सकता है?

उत्तर – नहीं।

सिर्फ Graphic Designer होना ही पर्याप्त नहीं है। सबसे पहले यह देखा जाता है कि कर्मचारी भारतीय श्रम कानून के अनुसार "Workman" की श्रेणी में आता है या नहीं।

यदि कर्मचारी "Workman" की श्रेणी में आता है, तो वह Labour Court का सहारा ले सकता है।

यदि कर्मचारी Managerial या Administrative पद पर कार्य कर रहा था, तो सामान्यतः उसका मामला Labour Court के बजाय Civil Court या अन्य उपयुक्त मंच पर जा सकता है।


"Workman" कौन होता है?

Industrial Disputes Act, 1947 की धारा 2(s) में Workman की परिभाषा दी गई है।

यदि कोई कर्मचारी मुख्य रूप से निम्न प्रकार का कार्य करता है—

यदि Graphic Designer के साथ निम्न में से कोई घटना हुई है—

केवल "Performance Poor" लिखकर Terminate कर दिया गया।
कोई Warning Letter नहीं दिया गया।
कोई Show Cause Notice नहीं दिया गया।

तो कर्मचारी अपने अधिकारों के लिए कानूनी कार्रवाई करने पर विचार कर सकता है।


कौन-कौन से कानून लागू हो सकते हैं?

1. Industrial Disputes Act, 1947

यदि कर्मचारी "Workman" की श्रेणी में आता है, तो यह अधिनियम महत्वपूर्ण हो सकता है।

यदि किसी कर्मचारी को—

Dismiss किया गया हो,
Discharge किया गया हो,
Retrench किया गया हो,
Terminate किया गया हो,

Section 11A

यदि Labour Court पाती है कि Termination उचित नहीं थी, तो वह—

नौकरी वापस दिला सकती है।
Compensation दे सकती है।
उचित मामलों में Back Wages का आदेश दे सकती है।
बर्खास्तगी की सज़ा को संशोधित कर सकती है।

Section 25F

यदि मामला Retrenchment का है और कानून लागू होता है, तो नियोक्ता को वैधानिक प्रक्रिया, नोटिस तथा Compensation जैसी आवश्यक शर्तों का पालन करना होता है।


यदि कंपनी केवल "Performance Poor" कहकर नौकरी से निकाल दे तो क्या होगा ?

केवल "Performance Poor" लिख देना ही पर्याप्त नहीं होता।

वेतन नहीं मिलने पर क्या करें?

यदि विवाद व्यापक औद्योगिक विवाद का रूप ले लेता है या अन्य श्रम अधिकार भी प्रभावित हुए हैं, तो लागू कानून के अनुसार Labour Court/Industrial Tribunal का सहारा लिया जा सकता है।


Labour Authority क्या आदेश दे सकती है?

मामले के तथ्यों के अनुसार प्राधिकरण:

बकाया वेतन दिला सकती है।
अवैध कटौती वापस करवाने का आदेश दे सकती है।
उपयुक्त Compensation देने का आदेश दे सकती है (जहाँ कानून लागू हो)।

क्या Employer वेतन रोक सकता है?

Employer बिना कानूनी आधार के वेतन नहीं रोक सकता।

यदि वेतन रोका गया है, तो उसका वैध कारण होना चाहिए। केवल "कंपनी के पास पैसे नहीं हैं" कहना सामान्यतः कर्मचारी के अर्जित वेतन को रोकने का स्वतः कानूनी आधार नहीं बनता।

परिचय

भारत में श्रम कानून (Labour Laws) का उद्देश्य कर्मचारियों के अधिकारों की रक्षा करना, उद्योगों में संतुलन बनाए रखना और नियोक्ता (Employer) तथा कर्मचारी (Employee) के बीच स्वस्थ औद्योगिक संबंध स्थापित करना है।
